Both race teams sued NASCAR late last year after refusing to sign new agreements on charter renewals. The charter system is similar to franchises in other sports, but the charters are revocable by NASCAR and have expiration dates. 23XI, which is owned by Jordan and three-time Daytona 500 winner Denny Hamlin, allied with Front Row in suing NASCAR after 13 other organizations signed the renewals last September and those two organization refused.

“We are disappointed by today’s ruling by the Fourth Circuit Court of Appeals and are reviewing the decision to determine our next steps,” said Jeffery Kessler, attorney for 23XI and Front Row. “This ruling is based on a very narrow consideration of whether a release of claims in the charter agreements is anti-competitive and does not impact our chances of winning at trial scheduled for Dec. 1.

“We remain confident in our case and committed to racing for the entirety of this season as we continue our fight to create a fair and just economic system for stock car racing that is free of anticompetitive, monopolistic conduct.”

The two teams sued and asked for a temporary injunction that would recognize them as chartered teams for this season. The antitrust case isn’t scheduled to be heard until December.

The teams said they needed the injunction because the current charter agreement prohibits them from suing NASCAR. 23XI also argued it would be harmed because Tyler Reddick’s contract would have made him a free agent if the team could not guarantee him a charter-protected car.

The original judge ruled that NASCAR’s charter agreement likely violated antitrust law in granting the injunction. But when they heard arguments last month, the three judges at the the U.S. Court of Appeals for the Fourth Circuit in Richmond, Virginia, indicated they were skeptical of that decision.

The judges said in Thursday’s ruling they were not aware of any case that supports the lower court’s theory of antitrust law, so they vacated the injunction.

“In short, because we have found no support for the proposition that a business entity or person violates the antitrust laws by requiring a prospective participant to give a release for past conduct as a condition for doing business, we cannot conclude that the plaintiffs made a clear showing that they were likely to succeed on the merits of that theory,” the court said. “And without satisfaction of the likelihood-of-success element, the plaintiffs were not entitled to a preliminary injunction.”

The teams have 14 days to appeal to the full court. The injunction also has no bearings on the merits of the case, and the earliest NASCAR can treat the teams as unchartered — a charter guarantees their organizations a starting spot each week and prize money — is one week after the deadline to appeal, provided there is no pending appeal.

NASCAR has not said what it would do with the six charters held by the two organizations if they are returned to the sanctioning body. There are only 36 chartered cars for a 40-car field. If the teams do not appeal, the six entries would have to compete as “open” cars — which means they’d have to qualify on speed each week to make the race and they would receive a fraction of the money.

It’s not clear what would happen to Reddick’s contract. He goes to Michigan this weekend ranked sixth in the Cup Series standings. Both organizations are still seeking a win this season — Hamlin’s three victories are with Joe Gibbs Racing, the team he drives for.

Reddick is last year’s regular-season champion and competed for the Cup title last November.

Another week, another win for Shane van Gisbergen.

The Trackhouse Racing driver made it back-to-back wins for the first time in his young NASCAR Cup Series career with a dominating victory at Sonoma Raceway.

Van Gisbergen took the pole position for Sunday’s race in Sonoma after sweeping the pole positions and the race wins in both the Xfinity and Cup Series events last weekend in Chicago.

This weekend was a similar story with even more dominance on race day. In all, van Gisbergen led 97 of the 110 laps of the race. He’s by far the top driver on road courses this year with three wins (Mexico City, Chicago, Sonoma) out of four races.

“Trackhouse Racing gave me a great Chevrolet again. What a great couple of weeks!” van Gisbergen said after the race. “Just to execute, make no mistakes, have great pit stops, great strategy and be able to hold them off there at the end – it’s incredible. Chase (Briscoe) was driving really well. We had a lot of fun there.”

The New Zealander started Sunday’s race from the pole and kept in front early. He pitted just before the end of Stage 1, ceding the stage win to fellow Trackhouse Racing driver Ross Chastain, and re-took the lead soon after his stop to win Stage 2.

Another pit stop dropped him down the order during Stage 3 but he quickly recovered to take the lead once again by lap 90. He kept control through late caution periods to secure the win.

Chase Briscoe came home second – exactly where he started the race. Chase Elliott, Michael McDowell and Christopher Bell rounded out the top five.

“I don’t know if I really saw everything (van Gisbergen) had, truthfully,” Briscoe said after the race. “I felt like every time I would get close; he would just start driving back away. We were definitely the second-best car. I don’t really know what more I need – maybe a little bit a grip. But even if I had a little more grip, I don’t know if I’m going to be able to gain the speed that he had.

“But overall, great day for the Bass Pro Shops Toyota. This is by far my worst race track, so to run second to him, it definitely means a lot, so proud of the day.”

Round three of the in-season challenge saw the 32-driver field whittled down once again. Four drivers remain: Ty Dillon, John Hunter Nemechek, Ty Gibbs and Tyler Reddick.

Dillon and Nemechek square off next week in the top half of the bracket, while Gibbs and Reddick face off to decide the bottom half of the bracket.

The rest of the Cup Series field will have a much better chance at victory next weekend in Dover. That’s also the penultimate round of the NASCAR in-season challenge that will leave two drivers in contention for the $1 million prize.

Thirty-two drivers entered the in-season challenge. After three rounds, just four remain, including just one driver from the top 10 seeds. Here’s the bracket entering Round 4 in Dover:

Van Gisbergen’s win marks his third consecutive road course victory, further cementing his reputation as one of NASCAR’s elite road racers.

For the second straight week and third straight road-course race, Shane van Gisbergen is your winner. He captured the checkered flag during the Toyota/Save Mart 350 at Somoma Raceway on Sunday, July 13.

It is the fourth career Cup Series victory and third this season for the driver of Trackhouse’s No. 88 car. All of them have come on road courses.

He, of course, already had a playoff spot wrapped up.

Shane van Gisbergen is once again a road course winner in the NASCAR Cup Series.

van Gisbergen held off Chase Briscoe and Chase Elliott to win the Toyota/Save Mart 350 NASCAR Cup Series race at Sonoma Raceway. van Gisbergen led 97 of 110 laps to score the win and has won the last three road course races.

Ross Chastain, van Gisbergen’s Trackhouse Racing teammate, won the opening stage of the race for his first of the season. van Gisbergen pitted late in the second stage then passed Kyle Larson on the final lap of the stage to win it.

The race at Sonoma had six cautions for 17 laps and 12 lead changes.

Briscoe fakes a dive to the pit lane. Chase Elliott is the first car to the pit lane from 3rd and he brings many with him. Elliott restarts 14th with fresh tires.

11 to go

Green with 11 to go, van Gisbergen clears Briscoe up the hill into turn two. Noah Gragson spins in turn five and he’s run into by Ryan Preece as he sits in the middle of the track. Multiple others are collected and the caution is out.

Green with 7 to go, side by side up the hill. Shane van Gisbergen finally clears him in turn four. Ricky Stenhouse Jr is turned with help from Ty Gibbs in the esses and Stenhouse Jr slams the tire barrier, caution.

Green with 4 to go, they rub doors for the race lead and van Gisbergen clears Briscoe into turn three. Kyle Larson is around in turn four with help from John Hunter Nemechek. Larson clips Ryan Blaney as he spins across the track, no caution.

3 to go, Josh Berry turns Carson Hocevar in turn two in the battle for 8th, no caution.

2 to go, van Gisbergen leads by 1.3 seconds. Chase Elliott has climbed to 3rd with fresh tires. Elliott drops a wheel exiting turn two and he falls to 4th.

“With just 20 minutes remaining in the Chevrolet Grand Prix at Canadian Tire Motorsport Park, our driver Tom Dillmann, who was leading the race, made heavy contact with the barrier. Tom lost the car through no fault of his own because of a technical problem that we need to investigate,” the team’s statement read. “The impact was significant, and Tom was immediately taken to the medical center for evaluation.

“Thankfully, he’s OK and that’s the most important news for us today. Motorsport reminded us once again how unpredictable and risky it can be. Thank you all for your messages, support, and concern–we truly appreciate it.”

Track workers assisted Dillmann out of his damaged No. 43 ORECA 07-Gibson after he attempted to get out on his own. He was awake and alert, but placed on a stretcher and left via ambulance. According to IMSA, Dillmann was later taken to a nearby hospital for further evaluation.
