After several months of the antitrust lawsuit filed by 23XI Racing and Front Row Motorsports against NASCAR seemingly going in circles, a major development unfolded last week.
We aren’t lawyers here at Beyond the Flag and aren’t going to pretend to be, so we’ll cut to the chase and try to keep this as simple as possible.
Both 23XI Racing and Front Row Motorsports refused to sign the new charter agreement last year, and their ensuing lawsuit was based on the idea that NASCAR operates as a monopoly. The goal was to get better terms out of the new agreement after the old one, implemented in 2016, expired.
But before the 2025 season, a judge ruled that NASCAR had to allow them to race with not only the two charters they each already had, but with the additional charters they had planned on acquiring from Stewart-Haas Racing, making both teams three-car chartered teams. NASCAR had been attempting to block those charter transfers but was not allowed to do so.
The new charter agreement is a seven-year deal that aligns with the new seven-year, $7.7 billion media rights deal, which includes not only Fox and NBC but new broadcast partners Amazon Prime Video and TNT Sports.
There is an additional seven-year option which could extend the charter agreement through 2038, but another argument of these teams is that charters should be permanent, given their market price.
Now a judge has ruled in favor of NASCAR, and 23XI Racing and Front Row Motorsports could lose their charter status in as little as three weeks (now two), which would leave the Cup Series with only 30 chartered cars rather than 36 and cloud the future of the other six charters.
23XI Racing teammates Tyler Reddick and Bubba Wallace are said to have contracts which allow them to seek new rides if their entries are not chartered. But without charters, they, along with rookie teammate Riley Herbst and the Front Row Motorsports trio of Todd Gilliland, Noah Gragson, and Zane Smith, would no longer be locked into each race and would need to qualify to secure their spots.
Operating as non-chartered teams will also cost these two teams a significant amount of money.
The big winner here? Stewart-Haas Racing, ironically a team that no longer actually exists.
During the offseason litigation and back-and-forth regarding whether or not 23XI Racing and Front Row Motorsports would be able to operate with charters in 2025, NASCAR initially did block those two teams from acquiring their desired third charters from Stewart-Haas Racing.
Given the hefty price tag on charters, even if it’s not the $40 million figure it once was, this was a massive development, in that NASCAR was also effectively screwing over a team that had already shut down. They were preventing them from doing business with two clear-cut buyers willing to fork over a lot of money to confirm long-awaited expansions to their programs.
Team owner Gene Haas retained one of Stewart-Haas Racing’s four charters to run the new Haas Factory Team, but he had no use for any of the other three. One went to Trackhouse Racing as a part of a relatively straightforward transaction, but the other two, even now in June, remain in limbo.
Why Stewart-Haas Racing is the big winner here is because they were indeed able to part ways with their charters after the acquisitions were forced to be unblocked.
Their involvement is these transactions, and in the sport as a whole, is now done and dusted, and 23XI Racing and Front Row Motorsports have already been able to operate as chartered teams, notably with the third charters they acquired from the now defunct organization.
Had NASCAR been able to fully block those transfers, Stewart-Haas Racing would have been left with useless charters, and they would have had to hope for NASCAR to give them the appropriate compensation. Haas Factory Team were never going to run more than one car in 2025, and at that point, there were not any other serious potential buyers left for the other charters.
Instead, 23XI Racing and Front Row Motorsports got their way initially, only for the latest ruling to see their charter status in jeopardy moving forward. The future of their charters may be in question, but at least Stewart-Haas Racing aren’t around to have to deal with the fallout.
While Hamlin reportedly remains confident, one can only wonder if he’s simply after leverage after the latest ruling. The simplest solution appears to be for the teams to sign the charter agreement and stop pursuing the lawsuit.
It’s no secret that the other 13 teams weren’t thrilled with the terms either, but they knew that it was the best they were going to get. Nearly a year later, they’ve been proven right.
This latest ruling has made it clear that, right or wrong, moral or immoral, and monopoly or no monopoly, NASCAR is going to get the favorable calls when it comes to this lawsuit, and the writing has been on the wall for some time now.
Rather than another six months of non-update “updates” rolling in, the case doing nothing more than going in circles, and two teams (and their six drivers) facing increasingly clouded futures, perhaps 23XI Racing and Front Row Motorsports should do what the other 13 teams did and bite the bullet.

Advance Auto Parts has forged a new partnership with Wood Brothers Racing, one of NASCAR’s most iconic organizations, for Sunday’s AutoTrader EchoPark Automotive 400 at Dover Motor Speedway.
Josh Berry will be piloting the No. 21 Advance Auto Parts Ford Mustang Dark Horse in the NASCAR Cup Series’ annual trip to the one-mile concrete oval, taking place on Sunday, July 20.
The addition of this partnership with Wood Brothers Racing further expands the motorsports portfolio of Advance Auto Parts, which also sponsors Ryan Blaney and Team Penske, as well as the NASCAR Advance Auto Parts Weekly Series — which allows short track racers to compete for track, state, regional, and national championships.
Berry is the 2020 NASCAR Advance Auto Parts Weekly Series champion, a triumph which assisted in springboarding the Hendersonville, Tennessee-native into NASCAR’s National Series on a full-time basis, and eventually into the NASCAR Cup Series.
“To have Advance Auto Parts on board at Dover is really special to me,” said Berry. “They’ve done so much to support grassroots racing across the country, and I’m proud to have won the Advance Auto Parts Weekly Series championship back in 2020. It means a lot to now represent them at the Cup level with Wood Brothers Racing.”
The 34-year-old driver is currently in his first year of NASCAR Cup Series competition with Wood Brothers Racing, after contesting his rookie campaign with Stewart-Haas Racing in 2024. Berry has already locked the team into the postseason with a win at Las Vegas Motor Speedway.
“Advance Auto Parts has been a tremendous supporter in raising the profile of short track racing across the country for the past several years, and this partnership aligns perfectly with Josh’s background,” said Jon Wood, president, Wood Brothers Racing. “He’s a product of the system they’ve supported and continues to represent the values of grassroots racing. We’re proud to have Advance Auto Parts on board the No. 21 car at Dover.”
The partnership also reflects Advance Auto Parts’ continued investment in driver development and the future of the sport.

Red Bull’s unexpected NASCAR comeback in 2025 is already making headlines in Victory Lane. Partnering with Trackhouse Racing, the iconic energy drink brand has returned to stock car racing for the first time since 2011, sponsoring both Van Gisbergen and rising prospect Connor Zilisch.
The decision to return, mainly due to Van Gisbergen’s long-standing Red Bull partnership in Australian Supercars, is already paying off.
Why Does Kevin Harvick Think Red Bull’s NASCAR Return Matters?
On his “Happy Hour” podcast, Harvick praised Red Bull’s return to NASCAR’s Victory Lane and called it a significant moment for the energy drink giant’s renewed involvement in stock car racing.
“When you look at SVG, well there’s a couple things here,” Harvick said. “One, the sponsor on the side of that car. Okay, well, when you have Red Bull on the side of your car.”
Harvick pointed out that Red Bull’s previous stint in NASCAR, beginning around 2005, ended in disappointment due to poor team performance and a lack of lasting impact. But with Van Gisbergen taking wins and bringing Zilisch into the fold under the Red Bull banner, Harvick sees a sharp contrast.
“Red Bull came into this sport in 2005-ish, and had just a terrible experience with the way that they put the team together, the performance on the racetrack, everything that happened with Red Bull’s experience in NASCAR is the exact opposite of what happened yesterday,” Harvick said. “With Shane going to Victory Lane, his relationship, bringing Connor Zilisch on board with that Red Bull relationship.”
While Harvick emphasized that he doesn’t typically focus on sponsors, Red Bull’s success with SVG signals something bigger for the sport.
“Normally I don’t sit here and talk about sponsors,” Harvick said. “But to me this is a big deal to have Red Bull in Victory Lane, and have Red Bull back in NASCAR racing because the energy drink sector of what we do, we need Red Bull and Monster to compete. Whether it be marketing, advertising, well just like Budweiser, Coors Light, Miller Light used to do back in the day.”
With Van Gisbergen now a proven winner and Red Bull visibly invested, Harvick believes NASCAR could be headed for a new era of big-brand rivalries.
“When you have those big companies like that that are engaged in the marketing side of things, it brings a whole new element to the marketing side of things, and that is good for our sport,” Harvick said.

The NASCAR Cup Series and Xfinity Series are set to race at the ‘monster mile’ on Saturday and Sunday, respectively, with Hendrick Motorsports set to field a new driver in their No. 17.

That’s right, the team have confirmed that Jake Finch will be piloting the No. 17 Chevrolet this weekend on one of its 16 outings this season.
So far this campaign, the likes of William Byron, Alex Bowman, Kyle Larson, Chase Elliott and Corey Day have all driven the No. 17 in Xfinity Series events, with the car having picked up two wins and seven finishes inside the top five.
Now, Finch is set to take the wheel, with the 20-year-old set for his NASCAR Xfinity Series debut, having previously raced in the ARCA Menards Series this season.

NASCAR fans respond to Hendrick Motorsports announcement
NASCAR fans in the replies to Hendrick Motorsports’ announcement were not best pleased with the news, however, with several fans calling for Rajah Caruth to get an opportunity to drive the No. 17.
Caruth currently drives full-time in the NASCAR Truck Series with Spire Motorsports, but he is backed by Hendrick Motorsports, with his car adorned in the blue, white and red of Hendrickcars.com.
Caruth has raced for Hendrick Motorsports in the Xfinity Series once previously, and some fans feel he should be given another opportunity.
“Why isn’t Caruth getting opportunities in the 17?” one X user wrote, for example, whilst another added: “Can we get a Rajah Caruth start in the 17 before the end of the year too please.”
It remains to be seen whether or not Caruth will indeed get a run out in the No. 17 this season, but the good news is he is going to get an opportunity in the Xfinity Series this weekend.
Jordan Anderson Racing have confirmed that Caruth will be driving their No. 32 Chevrolet at Dover this weekend, with EventsDC supporting the effort.
It will be Caruth’s first appearance in the Xfinity Series this season, with his last run out in the series having come at Phoenix last November.

“I clinched the World Championship where my idol, Alberto Ascari, won the first race, in Monza, in Italy. So, how could that ever happen in life?” he said.
Andretti sees a bright future for motorsports in America, particularly with the growing fanbase for Formula 1.
“Because now, you have three races in America, which is like no other country on the planet,” he said.

Andretti is 85 years old, and his professional career spanned from the 1950s through the 1990s.
