Lawyers representing 23XI Racing and Front Row Motorsports say NASCAR is trying to distract and shift attention away from its own unlawful, monopolistic actions.

CHARLOTTE, N.C. — The two teams suing NASCAR asked a judge to dismiss the sanctioning body’s counterclaim in court Wednesday.

In a 20-page filing in district court in North Carolina, 23XI Racing and Front Row Motorsports opposed NASCAR’s motion to amend its original counterclaim. The teams argued that the need to amend the counterclaim further demonstrates the weakness of NASCAR’s arguments, calling them an attempt by NASCAR to distract and shift attention away from its own unlawful, monopolistic actions.

NASCAR’s counterclaim singled out Michael Jordan’s longtime business manager, Curtis Polk. Jordan is co-owner of 23XI Racing.

The legal battle began after more than two years of negotiations on new charter agreements — NASCAR’s equivalent of a franchise model — and the 30-page filing contends that Polk “willfully” violated antitrust laws by orchestrating anticompetitive collective conduct in connection with the most recent charter agreements.

23XI and Front Row were the only two organizations out of 15 that refused to sign the new agreements, which were presented to the teams last September in a take-it-or-leave-it offer a mere 48 hours before the start of NASCAR’s playoffs.

The charters were fought for by the teams ahead of the 2016 season and twice have been extended. The latest extension is for seven years to match the current media rights deal and guarantee 36 of the 40 spots in each week’s field to the teams that hold the charters, as well as other financial incentives. 23XI and Front Row refused to sign and sued, alleging NASCAR and the France family that owns the stock car series are a monopoly.

NASCAR returns to historic North Wilkesboro Speedway for the annual All-Star race weekend for the Cup Series, along with race number 10 of the 2025 season for the Truck Series. The ARCA Menards Series East is off to Flat Rock Speedway in Michigan for its fourth race of the season. NHRA is back in action at Route 66 Raceway in Joliet, Illinois as the summer stretch of races begins. And finally, the GR Cup Series enters its third race weekend of the season at Sebring International Raceway.

NASCAR National Series – NCS/NCTS

Toyota bouts for inaugural Manufacturers Showdown … The 2025 NASCAR All-Star Race has some new elements included to amplify the excitement of the annual event, including the new “Manufacturer Showdown.” All three manufacturers in the Cup Series will compete against each other with the best combined overall finish among the three determining the winner. The number of cars per manufacturer will be determined once the All-Star main event field is set, with whichever manufacturer that has the least number of cars in the main event determining the amount the other two have in the challenge as well. The lowest cumulative score among the three OEMs determines the victor.

Crews makes Trucks debut … Toyota Development Driver Brent Crews arrives to North Wilkesboro Speedway this weekend to make his debut in the NASCAR Truck Series where he will pilot the No. 1 Toyota Tundra TRD Pro for TRICON Garage. The 17-year-old has thoroughly impressed in his young racing career so far, including the 2024 World Series of Asphalt Late Model championship; the 2023 SCCA TransAm TA2 Pro-Am championship; multiple wins in ARCA Menards Series competition – most recently at Rockingham Speedway in the East series – among other notable successes.

Heim seeks North Wilkesboro repeat … After another Truck Series top-five finish last weekend in Kansas and a solid season debut in the Cup Series, Corey Heim is back at North Wilkesboro Speedway looking for a repeat victory. The 22-year-old Toyota Development Driver led 62 laps on the way to victory the event last year at the 0.625-mile short oval for his eighth career Truck Series win at the time. The driver of the No. 11 Toyota Tundra TRD Pro for TRICON Garage has serious momentum entering the weekend, with six consecutive top-10 finishes and still standing as the Truck Series points leader.

NASCAR Regional Series – ARCA Menards Series East

Reaves goes for third straight win … Max Reaves has had a dazzling beginning to his career in the ARCA Menards Series East, with two victories in his first two career starts at Five Flags Speedway and Nashville Fairgrounds Speedway. Reaves and his No. 18 Toyota Camry head to Flat Rock Speedway this weekend in search of his third straight victory during the 2025 campaign.

NHRA – Top Fuel/Funny Car

Langdon continues as points leader heading to Chicago … With his win three weeks ago in Charlotte, Shawn Langdon enters race number six at Route 66 Raceway in Joliet, Illinois, with a 59-point lead in the NHRA Top Fuel standings. The 2013 Top Fuel world champion has two event victories and 12 round wins already on the season to put him firmly in the top spot. Closely following him in the standings are Antron Brown in third, Doug Kalitta in fourth, and Justin Ashley in sixth entering the weekend.

Brown seeks Chicago repeat … Last year in Joliet, Brown captured the first of what would be six race victories in 2024 to propel him to his fourth NHRA Top Fuel world championship. Brown is back at the Illinois dragstrip in hopes of a repeat triumph and his fifth overall Top Fuel victory at Route 66 Raceway.

GR Cup

Championship battle heats up in Sebring … As the Toyota GR Cup Series enters its fourth race weekend of the 2025 season, the series championship battle is beginning to take shape. The top three in the series points – Jaxon Bell (first), Westin Workman (second) and Lucas Weisenberg (third) – are all within a seven-point gap entering Sebring this weekend. Bell and Weisenberg have both captured victories so far this season, while Workman has three podiums in four races so far this season.

The NASCAR Whelen Modified Tour is set to open NASCAR’s All-Star Race day on Sunday at North Wilkesboro Speedway, and NASCAR’s oldest division is bringing a stacked entry list for their 150-lap race.

2025 NASCAR Whelen Modified Tour at North Wilkesboro Speedway

Headlining the entry list is the four-time and defending NASCAR Whelen Modified Tour champion, Justin Bonsignore. The Holtsville, New York driver is the defending winner of this race, as he put in an absolutely dominating performance last October. Bonsignore led 130 of the 150 laps and won by 6.473 seconds. He lapped all the way up to fifth-place too, all the while telling his competitors with one race left on the calendar that he was going to win the championship no matter what.

But after two races in 2025, Bonsignore’s season has not gotten started the way he would have hoped. He rebounded from two laps down to finish third at New Smyrna, but late-race contact on pit road and a bad restart at Thompson left him with a fifth-place finish. Is a third and a fifth in two races bad? No, but it’s still beyond the norm for the 45-time race winner. But heading to North Wilkesboro after last October’s dominating race might be exactly what Bonsignore and his Ken Massa Motorsports team led by crew chief Ryan Stone needs.

A fun addition to the entry list this week is a past winner of the NASCAR All-Star race in one of Modified racing’s most historic race cars. Ryan Newman, the winner of the 2002 All-Star race, then known as “The Winston,” will pilot the legendary No. v4 “Mystic Missile” Modified in place of Tim Connolly, who is recovering from surgery. Newman took the victory in 2022’s first Modified race during the “Racetrack Revival” week of festivities. He also finished 13th in last October’s race at North Wilkesboro driving Gary Putnam’s No. 77.

Speaking of Putnam’s No. 77, that car will be driven on Sunday by former NASCAR Cup Series driver and former NASCAR Whelen Modified Tour race winner, Corey LaJoie. Sunday’s race will be LaJoie’s first NWMT start in nearly two years. LaJoie’s last race came at New Hampshire Motor Speedway in the summer of 2023 where he finished seventh. His previous Modified start before that race came at Martinsville Speedway at the end of the 2022 season, which ended with LaJoie celebrating in victory lane.

The driver who finished second in this race last year, albeit a distant second, was Northampton, Pennsylvania’s Matt Hirschman. Hirschman is back on the entry list this weekend and is looking for his second victory at North Wilkesboro Speedway. Hirschman won this race two years ago on the old pavement at the end of 2023.

Speaking of Northampton, Pennsylvania, Hirschman’s neighbor, Austin Beers finished one spot behind Hirschman in this race last year. Beers led four laps in last year’s race. Beers has also won the pole for this race each year it has been held so far.

Lastly, the current points leader, Patrick Emerling, has been on fire to start off 2025. He dominated much of the World Series of Asphalt at New Smyrna Speedway, he scored the season-opening NASCAR Whelen Modified Tour race also at New Smyrna after starting dead last, and rebounded from a pit road mistake to finish second at Thompson. Emerling was decent at North Wilkesboro last year, finishing a distant fourth behind Bonsignore, Hirschman, and Beers.

The entire entry list for Sunday’s NASCAR Whelen Modified Tour “FaithFest Evangelistic Ministries 150” at North Wilkesboro Speedway can be found below.

Sunday’s race can be seen live on FloRacing as part of the FloRacing subscription, as can all NASCAR Whelen Modified Tour races all season long. Fans can subscribe to FloRacing by clicking here.

Kyle Larson’s Fill-In Announced For NASCAR All-Star Qualifying, Practice

This weekend’s NASCAR Cup All-Star Race at North Wilkesboro Speedway will see a different driver in the No. 5 HendrickCars.com Chevrolet for practice and qualifying sessions.

Justin Allgaier, who drives for JR Motorsports in the NASCAR Xfinity Series, will step in for Kyle Larson as the former NASCAR Cup champ will be at Indianapolis Motor Speedway preparing to qualify for the Indianapolis 500 as part of his Double attempt — racing the Indy 500 and the Coca-Cola 600 on the same day May 25.

Allgaier’s role extends beyond practice and qualifying, too, as he’ll also be the standby driver for May 18’s All-Star Race and May 25’s Coca-Cola 600.

Last year, Allgaier stepped up to start the Coca-Cola 600 in the No. 5 car when weather disrupted Larson’s Double attempt. Allgaier started 10th and finished 13th in the Coke 600 that only lasted 249 of 400 laps because of rainy weather.

“We’re fortunate to have Justin and we appreciate him stepping in to help,” said Cliff Daniels, crew chief for the No. 5 team. “He and Kyle are very similar in size, so there’s a lot in the cockpit that’s common between the two.

“He’s had some time in the simulator driving the track and he did the wheel-force test there a year ago, so he’s got some experience in the Cup car at North Wilkesboro,” Daniels added. “We’re looking to put in a solid practice and make sure the car drives good.”

Practice for the All-Star Race is scheduled for Friday at 5:05 p.m., with qualifying for heat races at 7:05 p.m. Since Larson won’t be available for qualifying, he’ll start at the tail-end of the field in Sunday’s main event. .

“I think no matter what there’s going to be a general progression of balance from Friday through Sunday,” Daniels said. “The track is going to take more rubber. Friday, the groove is going to be a bit more narrow and Sunday I think it’s going to open up a bit. So, there’s still some changes regardless of Justin or Kyle that we would plan to progress through throughout the weekend.

“At the end of the day, I just want to make sure Justin is comfortable in what he feels and he, of course, trusts the feedback he’s going to give us. If there’s something he can provide to us to make the car faster, we’re going to listen. We’re going to do those little things and then we’re going to kind of stick to a little bit of what we think the track is going to evolve through, throughout the weekend.”

Law passed by NC Senate looks to limit power of HOAs

WILMINGTON, NC (WWAY) — A bill moving through the North Carolina General Assembly could limit the power of homeowners associations across the state.

Senate Bill 378 passed the state Senate 47-0 last week and now heads to the House for consideration.

If approved, the bill would place a cap on HOA fines, bar foreclosures over unpaid HOA fines, and ban HOAs from fining people who run home businesses like music lessons or tutoring services.

Charles Williams with NC Citizens for HOA Reform says the state still has a long way to go, but this is a step in the right direction.

“There is not a single agency in this state that has oversight of the HOA industry. So, if you have a problem, there is really no place as a homeowner for you to go,” he explained.

Williams says North Carolina has some of the weakest HOA laws in the country.

For more than a decade, similar bills have been introduced in the NC House and Senate, but none of them have become law.

“My counterpart on the other side of the issue, they’ve got some really good attorneys, they’ve got some really deep pockets, and they have some good lobbyists,” Williams noted.

One such bill is House Bill 444, sponsored by representative Frank Iler of Brunswick County. It would have placed several regulations on HOAs, but missed a key deadline to pass the house.

Iler says he’s yet to read all of SB 378, but hopes to add parts of his bill to it.

“I just got to get my checklist out of what all needs to be in there and then, of course, we can amend it,” he said.

Iler—who has sponsored other HOA legislation in the past—says the issue isn’t about HOAs as a whole, just the bad actors.

“We got 2,000 municipalities, 14,000 HOAs. If 5% are not happy, that’s 700,” Iler noted. “So, that’s still a big number, and the letters and emails just keep coming in.”

Williams agrees, saying responsible HOAs have nothing to fear.
