23XI Racing and Front Row Motorsports (FRM) have suffered a major setback in their legal battle against Nascar over the charter system after the US Court of Appeals overturned the injunction agreed in December 2024.

The injunction had meant 23XI and FRM were allowed to compete in the Nascar Cup Series and receive the same benefits as other chartered teams while still pursuing their lawsuit against the series. The ruling also granted the teams permission to purchase charters from Stewart-Haas Racing and that Nascar must approve those purchases.

This has now been overturned in a hearing where judges questioned the teams’ attorney Jeffrey Kessler on why they should enjoy the benefits of the charter agreement while suing Nascar over the particulars of it. The fact this case was without precedence was cited as a key reason for the ruling, with the judges stating that the ‘theory of antitrust law’ asserted by 23XI and FRM ‘is not supported by any case of which we are aware’.

The US Court of Appeals also said that the teams failed to make a ‘clear showing that they were likely to succeed’ in their case. Without that, the injunction was revoked.

The ruling won’t take effect for two weeks, which gives 23XI and FRM the chance to appeal. But, if this passes, the teams will have to compete as open teams for the remainder of the 2025 season.

As open entries, 23XI and FRM are no longer guaranteed entry to races and will earn less than a third of what a chartered team makes for competing in a race. FRM team owner Bob Jenkins claimed in the original injunction that the payout from the purse would be so low as an open entry that it would not cover the costs of going to the racetrack.

It should be noted, though, that both teams were prepared to enter the 2025 season as open entries before the surprise decision to allow an injunction was passed. 

‘We are disappointed by today’s ruling by the Fourth Circuit Court of Appeals and are reviewing the decision to determine our next steps,’ read a statement from Kessler.

‘This ruling is based on a very narrow consideration of whether a release of claims in the charter agreements is anti-competitive and does not impact our chances of winning at trial scheduled for December 1st.

‘We remain confident in our case and committed to racing for the entirety of this season as we continue our fight to create a fair and just economic system for stock car racing that is free of anticompetitive, monopolistic conduct.’

This is the latest twist in a long and complicated case that has seen the two teams initially refuse to sign Nascar’s proposal for a new charter agreement in September 2024 before filing an antitrust lawsuit against the series, in which they accused the organisation of monopolistic practices.

Their request for an injunction was initially rejected by US District Judge Frank D Whitney, but then US District Judge Kenneth D Bell later agreed to the injunction.

The trial date for the lawsuit is set for December of this year.

Advance Auto Parts has forged a new partnership with Wood Brothers Racing, one of NASCAR’s most iconic organizations, for Sunday’s AutoTrader EchoPark Automotive 400 at Dover Motor Speedway.

Josh Berry will be piloting the No. 21 Advance Auto Parts Ford Mustang Dark Horse in the NASCAR Cup Series’ annual trip to the one-mile concrete oval, taking place on Sunday, July 20.

The addition of this partnership with Wood Brothers Racing further expands the motorsports portfolio of Advance Auto Parts, which also sponsors Ryan Blaney and Team Penske, as well as the NASCAR Advance Auto Parts Weekly Series — which allows short track racers to compete for track, state, regional, and national championships.

Berry is the 2020 NASCAR Advance Auto Parts Weekly Series champion, a triumph which assisted in springboarding the Hendersonville, Tennessee-native into NASCAR’s National Series on a full-time basis, and eventually into the NASCAR Cup Series.

“To have Advance Auto Parts on board at Dover is really special to me,” said Berry. “They’ve done so much to support grassroots racing across the country, and I’m proud to have won the Advance Auto Parts Weekly Series championship back in 2020. It means a lot to now represent them at the Cup level with Wood Brothers Racing.”

The 34-year-old driver is currently in his first year of NASCAR Cup Series competition with Wood Brothers Racing, after contesting his rookie campaign with Stewart-Haas Racing in 2024. Berry has already locked the team into the postseason with a win at Las Vegas Motor Speedway.

“Advance Auto Parts has been a tremendous supporter in raising the profile of short track racing across the country for the past several years, and this partnership aligns perfectly with Josh’s background,” said Jon Wood, president, Wood Brothers Racing. “He’s a product of the system they’ve supported and continues to represent the values of grassroots racing. We’re proud to have Advance Auto Parts on board the No. 21 car at Dover.”

The partnership also reflects Advance Auto Parts’ continued investment in driver development and the future of the sport.

Kevin Harvick believes Shane van Gisbergen’s recent NASCAR success could mark a pivotal turning point, not just for Trackhouse Racing, but for the sport’s commercial landscape as well.

Red Bull’s unexpected NASCAR comeback in 2025 is already making headlines in Victory Lane. Partnering with Trackhouse Racing, the iconic energy drink brand has returned to stock car racing for the first time since 2011, sponsoring both Van Gisbergen and rising prospect Connor Zilisch.

The decision to return, mainly due to Van Gisbergen’s long-standing Red Bull partnership in Australian Supercars, is already paying off.

Why Does Kevin Harvick Think Red Bull’s NASCAR Return Matters?

On his “Happy Hour” podcast, Harvick praised Red Bull’s return to NASCAR’s Victory Lane and called it a significant moment for the energy drink giant’s renewed involvement in stock car racing.

“When you look at SVG, well there’s a couple things here,” Harvick said. “One, the sponsor on the side of that car. Okay, well, when you have Red Bull on the side of your car.”

Harvick pointed out that Red Bull’s previous stint in NASCAR, beginning around 2005, ended in disappointment due to poor team performance and a lack of lasting impact. But with Van Gisbergen taking wins and bringing Zilisch into the fold under the Red Bull banner, Harvick sees a sharp contrast.

“Red Bull came into this sport in 2005-ish, and had just a terrible experience with the way that they put the team together, the performance on the racetrack, everything that happened with Red Bull’s experience in NASCAR is the exact opposite of what happened yesterday,” Harvick said. “With Shane going to Victory Lane, his relationship, bringing Connor Zilisch on board with that Red Bull relationship.”

While Harvick emphasized that he doesn’t typically focus on sponsors, Red Bull’s success with SVG signals something bigger for the sport.

“Normally I don’t sit here and talk about sponsors,” Harvick said. “But to me this is a big deal to have Red Bull in Victory Lane, and have Red Bull back in NASCAR racing because the energy drink sector of what we do, we need Red Bull and Monster to compete. Whether it be marketing, advertising, well just like Budweiser, Coors Light, Miller Light used to do back in the day.”

With Van Gisbergen now a proven winner and Red Bull visibly invested, Harvick believes NASCAR could be headed for a new era of big-brand rivalries.

“When you have those big companies like that that are engaged in the marketing side of things, it brings a whole new element to the marketing side of things, and that is good for our sport,” Harvick said.

Hendrick Motorsports have officially announced a new driver deal ahead of this weekend’s NASCAR action at Dover, with fans making their feelings known in response.

The NASCAR Cup Series and Xfinity Series are set to race at the ‘monster mile’ on Saturday and Sunday, respectively, with Hendrick Motorsports set to field a new driver in their No. 17.

That’s right, the team have confirmed that Jake Finch will be piloting the No. 17 Chevrolet this weekend on one of its 16 outings this season.

So far this campaign, the likes of William Byron, Alex Bowman, Kyle Larson, Chase Elliott and Corey Day have all driven the No. 17 in Xfinity Series events, with the car having picked up two wins and seven finishes inside the top five.

Now, Finch is set to take the wheel, with the 20-year-old set for his NASCAR Xfinity Series debut, having previously raced in the ARCA Menards Series this season.

NASCAR fans respond to Hendrick Motorsports announcement

NASCAR fans in the replies to Hendrick Motorsports’ announcement were not best pleased with the news, however, with several fans calling for Rajah Caruth to get an opportunity to drive the No. 17.

Caruth currently drives full-time in the NASCAR Truck Series with Spire Motorsports, but he is backed by Hendrick Motorsports, with his car adorned in the blue, white and red of Hendrickcars.com.

Caruth has raced for Hendrick Motorsports in the Xfinity Series once previously, and some fans feel he should be given another opportunity.

“Why isn’t Caruth getting opportunities in the 17?” one X user wrote, for example, whilst another added: “Can we get a Rajah Caruth start in the 17 before the end of the year too please.”

It remains to be seen whether or not Caruth will indeed get a run out in the No. 17 this season, but the good news is he is going to get an opportunity in the Xfinity Series this weekend.

Jordan Anderson Racing have confirmed that Caruth will be driving their No. 32 Chevrolet at Dover this weekend, with EventsDC supporting the effort.

It will be Caruth’s first appearance in the Xfinity Series this season, with his last run out in the series having come at Phoenix last November.
