NASCAR issue scathing response as Cup teams file for restraining order against series

NASCAR has issued a scathing response after 23XI Racing and Front Row Motorsports (FRM) filed for a restraining order and a preliminary injunction that would see them retain their chartered status for the remainder of 2025. NASCAR has issued a scathing response after 23XI Racing and Front Row Motorsports (FRM) filed for a restraining order and a preliminary injunction that would see them retain their chartered status for the remainder of 2025.

The team co-owned by Michael Jordan and Denny Hamlin, along with their fellow Cup Series outfit FRM, sued NASCAR last October alleging anticompetitive and monopolistic practices after refusing to sign up to the series’ new charter agreement.

Crucially, however, the teams were granted an injunction ahead of the 2025 campaign that would allow them to compete as chartered teams.

NASCAR appealed that decision, and last month, a three-judge appeals panel sided with the series, overturning the injunction. This left 23XI and FRM facing the prospect of losing their charters, and the tens of millions of dollars that come with them.

As a result, the teams sought a full rehearing on the matter, but their appeal was denied last week, meaning that both teams could be stripped of their charters ahead of this weekend’s action at Dover Motor Speedway.

However, in an effort to prevent this, another filing has now been made by 23XI and FRM, seeking a temporary restraining order and injunction that would prevent their charters from being stripped for the rest of the season.

NASCAR issue scathing 23XI and FRM statement

Now, in response to the teams’ latest court filing, NASCAR has released a somewhat scathing statement on the matter, labeling the lawsuit as ‘damaging’ and ‘distracting’.

“It is unfortunate that instead of respecting the clear rulings of the Fourth Circuit, 23XI Racing and Front Row Motorsports are now burdening the District Court with a third motion for another unnecessary and inappropriate preliminary injunction,” NASCAR said in a statement.

“As both the Fourth Circuit and the District Court suggested, NASCAR has made multiple requests to 23XI Racing and Front Row Motorsports to present a proposal to resolve this litigation. We have yet to receive a proposal from 23XI or Front Row, as they have instead preferred to continue their damaging and distracting lawsuit.

“We will defend NASCAR’s integrity from this baseless lawsuit forced upon the sport that threatens to divide the stakeholders committed to serving race fans everywhere.

“We remain focused on collaborating with the 13 race teams that signed the 2025 charter agreements and share our mutual goal of delivering the best racing in the world each week, including this weekend in Dover.”

If 23XI and FRM’s latest filing is denied, the teams could be racing as open entries as soon as this weekend’s race at Dover Motor Speedway, meaning they would no longer be guaranteed entry to all races, nor a portion of the event prize fund.

NASCAR has been given until 5 pm ET on Wednesday to legally respond to 23XI and FRM’s latest court filing.

The wider lawsuit case is set to be heard in court on December 1, 2025.

What’s Happening?

Brenden “Butterbean” Queen, the current ARCA Menards Series Points Leader, will make his return to the Craftsman Truck Series with Spire Motorsports at Lucas Oil Raceway Park on Jul. 25.

  • Queen made his NASCAR National Series debut in the Craftsman Truck Series with TRICON Garage last season. In three starts, the 26-year-old finished no higher than 4th, doing so in his debut at North Wilkesboro Speedway.
  • While 2024 marked his official NASCAR debut, Queen’s focus last season was on Late Model racing, winning the CARS Tour Late Model Stock Car championship. This spring, the 27-year-old announced his switch to the ARCA Menards Series, where he currently competes for Pinnacle Racing Group in their No. 28 entry.
  • This past February at Daytona, Queen’s first ARCA start since 2019, the short track ace won the series season opener. He has since won two more races and has only failed to finish inside the top-five twice, resulting in a nine-point lead in the series standings over Venturini Motorsports’ Lawless Alan.
  • Queen will drive the No. 07 truck for Spire at IRP, one of the team’s two part-time trucks in their four-truck stable. He joins a list of twelve drivers, including names such as Kyle Larson, Kyle Busch, and Michael McDowell, to have driven the No. 07 this season.

Crown Concepts, a premier performance automotive business based in Arizona, has announced the acquisition of Racing Equipment Sales (trading as Radical Arizona) and the signing of a full dealership agreement with Radical Motorsport, the global manufacturer of world-renowned purpose-built race cars.

The agreement solidifies Crown Concepts’ position as the Southwest’s leading destination for Radical sales, service, parts, engine rebuilds, and national-level racing support.

“We’ve supported Radical drivers for years,” said Curtis Brown, CEO at Crown Concepts. “This acquisition formalizes a long-standing relationship and opens the door to an even more immersive experience for drivers looking to go fast, compete hard, and have fun. We’re proud to offer full-spectrum Radical support, from test drives to racing.”

As part of the agreement, Crown Concepts will continue to operate from its 27,500 sq. ft., Tucson-based performance facility, while also supporting Radical drivers at Apex Motor Club, Inde Motorsports Ranch, Podium Club and national-level Radical Cup events.

“Crown Concepts has consistently impressed us with their technical expertise, hospitality, and deep connection to the Radical community,” said Tom Drewer, Director of the Americas for Radical Motorsport. “We’re thrilled to welcome them as an official dealer and look forward to accelerating Radical’s presence in Arizona and beyond.”

The transaction includes the acquisition of Radical Arizona from long-time steward Jason Plotke, who helped build one of the most successful Radical dealerships worldwide in Arizona through his leadership and close ties with Apex Motor Club.

“This transition is the natural evolution of a great story,” said Plotke, Co-Founder of Apex Motor Club and former owner of Radical Arizona.

“Crown has been a trusted partner and a critical component of the Radical success created in Arizona, both on and off the track. Their investment here isn’t just financial, it’s cultural, and it ensures that Radical customers will be well taken care of for years to come.”

Chris McMurry, Apex Motor Club member and Board member of Racer Media & Marketing, Inc., which owns the popular RACER brand that includes RACER.com, is a passionate Radical competitor who echoed Jason’s sentiment.

“As a driver and longtime fan of the Radical platform, I’ve seen firsthand how Crown Racing elevates the experience. Their commitment to excellence, whether in the garage or on the grid, is second to none which is highlighted by the multiple Pro1340 Radical Cup North America Team Championships they have earned.”

Crown’s expanded offering will further support Radical racers at top Arizona tracks, with endorsements from partners throughout the motorsports ecosystem.

“Crown has been a pillar of performance at Apex since day one,” said Matt Williams, President of Apex Motor Club.

“Their acquisition of Radical Arizona is great news for our members and great news for Arizona motorsports.”

CJ Dorland, President at Inde Motorsports Ranch, added: “We’re looking forward to seeing many more Radical cars on the track here at Inde for our members to enjoy. Crown Concepts brings next-level expertise to the paddock and the pits.”

After two road course races, NASCAR heads to Dover Motor Speedway and its challenging 1-mile concrete oval. Moving from an April date to July is expected to bring higher temperatures to Delaware as drivers battle out the penultimate round of the In-Season Challenge.

A new Goodyear Racing Eagle tire setup designed specifically for the Monster Mile’s ever-changing track surface awaits NASCAR Cup Series teams. The new tire has been designed to withstand the high speeds and high loads associated with racing at Dover, and won’t be used at any other track this season.

“Laying rubber down on the concrete surface is a key factor in the design of our tread compounds for Dover,” said Rick Heinrich, Goodyear NASCAR product manager. “While the track turns black as cars lay rubber down during green flag racing, the hot tires then pick up this same rubber when the track cools under cautions. Dover presents a unique opportunity to engineer a tire to help in laying down rubber on a particularly smooth surface, and we’ve designed the product to do just that.”

In contrast to the new Cup Series setup, NASCAR Xfinity Series teams will use familiar tires at Dover. This is the fourth consecutive race at Dover using this Xfinity Series tire setup, and both tires have already been used this season: the left-side tire five times so far and most recently at Pocono, and the right-side tire at Nashville. Unlike the Cup Series, Xfinity Series teams use inner liners on ovals 1-mile and longer, including Dover.
