The U.S. Court of Appeals has ruled in NASCAR’s favor, after the sanctioning body made an appeal regarding the decision by the District Court to award a preliminary injunction to 23XI Racing and Front Row Motorsports last December.
That injunction, which has permitted 23XI Racing and Front Row Motorsports to compete as Chartered Entries in the NASCAR Cup Series, has been vacated, and now the team’s six collective charters are in limbo.
“We are disappointed by today’s ruling by the Fourth Circuit Court of Appeals and are reviewing the decision to determine our next steps,” said Jeffrey Kessler, lead attorney for 23XI Racing and Front Row Motorsports.
“This ruling is based on a very narrow consideration of whether a release of claims in the charter agreement is anti-competitive and does not impact our chances of winning at trial scheduled for December 1. We remain confident in our case and committed to racing for the entirety of this season as we continue to fight to create a fair and just economic system for stock car racing that is free of anticompetitive, monopolistic conduct.”
23XI Racing and Front Row Motorsports will have a 14-day window to petition for a re-hearing or a hearing in front of all of the appeals judges. Should that route not be taken, the ruling would not be eligible to be enforced until seven days after that deadline.
That 14-day window shuts on June 19, with the seven-day period afterwards (should nothing be done) ending on June 26, meaning that both 23XI Racing and Front Row Motorsports could be without charters for the June 28 event at EchoPark Speedway.
23XI Racing fields the No. 23 for Bubba Wallace, No. 35 for Riley Herbst, and No. 45 for Tyler Reddick. Front Row Motorsports fields the No. 4 for Noah Gragson, the No. 34 for Todd Gilliland, and the No. 38 for Zane Smith.
In court documents filed on Thursday, after the decision was made by Circuit Judges Niemeyer, Agee, and Thacker, the judges made the following statement:
“In entering a preliminary injunction in this case, the district court held that the plaintiffs were likely to succeed on the merits of their antitrust action against [NASCAR and it’s CEO, James France], because NASCAR, as an alleged monopolist, required the plaintiffs, as a condition of doing business with them, to enter into a release for past conduct,” court documents read. “Because that theory of antitrust law is not supported by any case of which we are aware, we conclude that it was not a likely basis for success on the merits and vacate the injunction.”
The main holdup, though, in allowing this preliminary injunction to stand, comes from the fact that there was no case law cited to support the decision that was made by the original judge.
“The court supplied no case law to support that theory. Indeed, we have found no case to support it, and the defendants claim that there is none. Rather, the court only cited cases holding that it may violate public policy for an agreement to operate ‘as a prospective waiver of a party’s right to pursue statutory remedies for antitrust violations’.
“Finally, the fact that a release may violate public policy by being prospective does not make it anticompetitive, as required for a violation of the antitrust laws.”
As a final statement, the panel of three judges, said: “In short, because we have found no support for the proposition that a business entity or person violates the antitrust laws by requiring a prospective participant to give a release for past conduct as a condition for doing business, we cannot conclude that the plaintiffs made a clear showing that they were likely to succeed on the merits of that theory. And without satisfaction of the likelihood-of-success element, the plaintiffs were not entitled to a preliminary injunction.”
“We therefore conclude that the district court abused its discretion in entering the preliminary injunction that it did. This is all the more true in view of the heightened standard for issuing a mandatory preliminary injunction and because the one here requested two parties engage in a business that one party claims to be illegal.

INDIANAPOLIS (WISH) — NASCAR has suspended Xfinity Series driver Austin Hill for one race following his actions during Saturday’s Pennzoil 250 at Indianapolis Motor Speedway.
As a result, the Richard Childress Racing driver will miss this weekend’s race at Iowa Speedway.
Hill hit Aric Almirola’s right rear late in the race on Saturday, which turned Almirola into the wall entering turn four.
Almirola’s race ended as a result of the crash.
“It was definitely intentional,” Almirola said following the incident on The CW’s broadcast of the race. “He blocked me three times. I finally got him loose in (turn) three. He had damage on the nose, so he was really slow in the corners, and so it was time to go.”
Almirola added that it was one of the biggest hits of his career.
Hill was held for five laps in the pits due to “rough driving” following the incident.
Richard Childress Racing posted the following on social media Tuesday following the announcement of Hill’s suspension:
“Richard Childress Racing will not appeal the penalty NASCAR issued to the No. 21 team following the NASCAR Xfinity Series race at Indianapolis Motor Speedway. We remain focused on winning a championship with Austin Hill in 2025.”
The post went on to say that Austin Dillon will race Hill’s No. 21 car at Iowa Speedway this weekend.
According to an article on NASCAR’s website regarding the suspension, “Hill’s absence from a regular-season race will require a waiver so that he may retain his eligibility for the Xfinity Series Playoffs. Under a rule established before the 2025 season, he will forfeit his total of 21 playoff points and be ineligible to collect more before the postseason begins.”
Connor Zilisch ended up winning this past Saturday’s race at Indianapolis Motor Speedway.

The renowned British driver, known for his versatility and style both on and off the track, will headline the annual gathering that ranks among the most prestigious vintage racing events in North America.
For fans of high-performance heritage, luxury automotive culture, and motorsports history, Button’s appointment brings added star power to an event already rich in provenance. With over 400 meticulously prepared, period-correct race cars competing across 14 race groups – including the eagerly-anticipated debut of a dedicated IROC class – this year’s Rolex Reunion promises a rare blend of authenticity, speed, and celebrity.

Sunday’s Iowa Corn 350 Powered by Ethanol will be the first race of the 2025 NASCAR Cup Series season televised on the USA Network. Outside of four races on NBC, USA Network will televise the remainder of the Cup Series schedule. The Iowa Corn 350 Powered by Ethanol takes the green flag at 3:30 p.m. ET.
Practice and qualifying for the NASCAR Cup Series at Iowa will be televised on truTV. Practice begins at 1:30 p.m. ET on Saturday, August 2, with qualifying following at 2:40 p.m. ET.

Richard Childress Racing (RCR) has responded to NASCAR suspending Austin Hill for his incident with Aric Almirola during the Xfinity Series race at Indianapolis this past weekend. RCR said it will not appeal the suspension and revealed who will replace Hill this weekend.
“Richard Childress Racing will not appeal the penalty NASCAR issued to the No. 21 team following the NASCAR Xfinity Series race at Indianapolis Motor Speedway,” the team said. “We remain focused on winning a championship with Austin Hill in 2025. Austin Dillon will race the No. 21 Chevrolet at Iowa Speedway.”
Austin Hill, the driver for the No. 21 Chevrolet for RCR, will miss this weekend’s event at Iowa Speedway. He hit Aric Almirola during the 91st lap of the Pennzoil 250. After Almirola bumped Hill into a slide in Turn 3, Hill hit Almirola’s right-rear fender, turning the No. 19 Toyota into the Turn 4 retaining wall.

After the race, Almirola reacted to being hit by Hill. “It was definitely intentional,” Almirola told The CW, per NASCAR.com. “He (Hill) blocked me three times. I finally got him loose in (Turn) 3. He had damage on the nose, so he was really slow in the corners. It was time to go. I mean, we’re coming to nine to go, and the leaders are starting to put a gap on us, so it’s time to go. I got him loose, and he just turned left and hooked me in the right rear.”
Hill wasn’t available for a comment after the race, but he told his team that the hit wasn’t intentional. “I couldn’t hang onto it. I did not try to right-rear him,” Hill told his team on the radio. “He had me out of control and I drove back to the left to keep it off the wall. I’m not sure what the hell he thought just running me over in 3 though!”

Audi has announced a new title sponsorship for its debut Formula 1 season in 2026, with financial techology company Revolut joining the sport for the first time.
The current Sauber team will become the Audi works outfit from next season, and Revolut will replace Stake as title partner. Audi describes the deal as a “landmark agreement” as it makes the announcement ahead of its entry, attracting what was ranked as Europe’s most valuable technology company last year, with a valuation of $45 billion.
“Audi is entering Formula 1 with a clear ambition: to use the platform as a technologically relevant and economically sustainable investment in the future of the Audi brand,” CEO Gernot Dollner said. “We firmly believe in the success of our project, which we are approaching with a realistic attitude and a mindset of continuous improvement.
“In Revolut, we have found a partner that shares our ambitions and attitude. Formula 1 is a global stage that offers us the opportunity to reach new target groups together and generate enthusiasm for our products.”
Revolut Business is set to be extensively integrated into the team’s financial operations, and Revolut customers – of which there are currently over 60 million – will also get exclusive benefits as part of the deal, according to Audi.
“With Revolut, we have found a partner that shares our core ethos of innovation and relentless ambition,” team principal Jonathan Wheatley said. “This is more than a brand fit; it is a strategic alliance, engineered to challenge conventions in motorsport. From 2026, Revolut’s digital-first solutions will power key areas of our operations while also redefining how fans and communities engage with our team – delivering a seamless and engaging experience on and off the track.”
Revolut CEO Nik Storonsky says the two brands are focused on trying to disrupt the established order in their respective fields, with F1 viewed as the ideal platform to tell the fintech company’s story.
“This is a monumental partnership for Revolut and the future Audi F1 Team,” Storonsky said. “We’re accelerating towards 100 million customers, and we’ll be bringing them into Formula 1 with unforgettable experiences at a pivotal time for the sport.
“As Revolut continues to challenge the status quo in global finance, the future Audi F1 Team is set to do the same in motorsport. With a shared outlook, global ambition and relentless drive for progress, this partnership will define what’s possible in Formula 1.”
