RICHMOND, Va. — A three-judge federal appellate panel indicated Friday it might overturn an injunction that allows 23XI Racing and Front Row Motorsports to compete as chartered teams in NASCAR’s top-tier Cup Series this season while the two organizations sue the stock-car sanctioning body for alleged antitrust violations.

NASCAR attorney Chris Yates argued the injunction, granted in December by U.S. District Judge Kenneth Bell of the Western District of North Carolina, forced the series into an unwanted relationship with unwilling partners. Yates also said it harms other teams because they earn less money.

Yates said the district court broke precedent by granting the injunction, saying the “release” clause in the charter contracts forbidding the teams from suing is “common.” He argued, essentially, that the teams should not have the benefits of the charter system they are suing to overturn.

Overturning the injunction would leave the two organizations able to race but without any of the perks of being chartered, including guaranteed weekly revenue. They would also have to qualify at every Cup Series race to make the field, which currently has only four open spots for each points race; 23XI and Front Row are each running three cars in Cup Series competition this season.

Judges Steven Agee, Paul Niemeyer and Stephanie Thacker, at multiple points during the 50-minute hearing at the U.S. Court of Appeals for the Fourth District, pushed back on the argument made by plaintiffs’ attorney Jeffrey Kessler, who accused NASCAR of being a monopoly.

“There’s no other place to compete,” Kessler told the judges, later noting that overturning the injunction would cause tremendous damage to the two teams, which could lose drivers and sponsors. “It will cause havoc to overturn this injunction in the middle of the season.”

The teams filed the antitrust lawsuit against NASCAR on Oct. 2 in the Western District of North Carolina, arguing the series bullied teams into signing new charters that make it difficult to compete financially. That came after two years of failed negotiations on new charter agreements, which are NASCAR’s equivalent of franchise deals in other pro sports leagues.

Of 15 charter-holding organizations, just two refused to sign the new agreements in September: 23XI Racing — which is co-owned by Joe Gibbs Racing driver Denny Hamlin, retired NBA star Michael Jordan and Curtis Polk, the basketball great’s longtime business partner — and Front Row Motorsports, which is owned by entrepreneur Bob Jenkins.

The charters, which teams originally signed before the 2016 season, have twice been extended. The most recent extension runs until 2031, matching NASCAR’s current media rights deal. It guarantees that 36 of the 40 available spots in weekly races will go to teams holding charters.

The judges expressed agreement with Yates’ argument that the district court had erred in issuing the injunction allowing the teams to race, because it mandated they sign the NASCAR charter but eliminated the contract’s release.

“It seems you want to have your cake and eat it, too,” Niemeyer told Kessler.

At another point, the judge pointedly told Kessler that if the teams want to race, they should sign the charter.

Yates contended that forcing an unwanted relationship between NASCAR and the two teams “harms NASCAR and other racing teams.” He said that more chartered teams would earn more money if not for the injunction, and he noted the two teams are being “given the benefits of a contract they rejected.”

Kessler argued that even if the district court’s reasoning was flawed, other evidence should lead the circuit court to uphold the injunction. Niemeyer disagreed.

“The court wanted you to be able to race but without a contract,” the judge said.

A trial date is set for December, and Agee strongly urged the sides to meet for mediation — previously ordered by a lower court — to attempt to resolve the dispute over the injunction.

“It’ll be a very interesting trial,” Agee said with a wry smile.

The prospect of successful mediation seems unlikely, though, with Yates telling the judges: “We’re not going to rewrite the charter.”

On Lap 67 of the NASCAR Cup race at Michigan International Speedway, Hendrick Motorsports driver Alex Bowman was racing deep in the pack when he found himself in a bad situation. After contact from Cole Custer, he ended up slamming the outside wall in a head-on impact that lifted the rear tires off completely the ground. Bowman’s No. 48 Chevrolet hit the wall at roughly 150mph, immediately ending his race.

Bowman later described it as perhaps the biggest hit of his career. Unfortunately, the 32-year-old has a history of injuries. He suffered a concussion following a crash at Texas Motor Speedway in 2022, missing five races as a result. In 2023, he suffered a back injury in a sprint car crash that forced him to miss three Cup races.

Thankfully, Bowman has been medically cleared to race this weekend in Mexico City despite some soreness. The road course event is a big opportunity for Bowman as his most recent win in the Cup Series came at the Chicago Street Course last summer.

As a precaution, Hendrick will have Anthony Alfredo on standby for Bowman at Autódromo Hermanos Rodríguez. Alfredo, who competes full-time in the NASCAR Xfinity Series, also works as a simulator driver for HMS. He has 42 starts in the Cup Series, including one start earlier this year at Talladega Superspeedway.

Bowman currently sits 13th in the championship standings after the first 15 races this year and is hoping for some positive momentum. He has finished 27th or worse in seven of the last nine races, including five finishes of 35th or worse in a dismal run for the No. 48 team.

Previewing NASCAR’s return to Mexico – Speedway Digest

NASCAR’s historic return to Mexico City marks a significant milestone for the sport, as the Cup Series prepares to race at Autódromo Hermanos Rodríguez on June 15, 2025, for the first points-paying international event since 1958.

This weekend, dubbed the Viva Mexico 250, not only brings the premier series to a global stage but also sees the Xfinity Series competing in The Chilango 150 on June 14, reviving NASCAR’s presence in Mexico after a 17-year absence. The event underscores NASCAR’s ambition to expand its reach and tap into the vibrant motorsport culture of a city with over 20 million residents.

The Autódromo Hermanos Rodríguez, a 2.42-mile road course with 15 turns, presents unique challenges for drivers and teams. Situated at an elevation of approximately 7,500 feet, the track’s thin air will test the car, engine performance and driver endurance.

To prepare, some competitors have trained in oxygen-deprived environments, utilizing hypoxic tents or specialized exercise regimens to adapt to the high altitude. The circuit, reconfigured since its last NASCAR event in 2008, features a distinctive section that cuts through a former baseball stadium, bringing fans closer to the action.

Its long start/finish straight, the longest among NASCAR’s road courses this season, promises intense racing moments.

This weekend holds special significance for Trackhouse Racing, a team with deep ties to the event. Daniel Suarez, the only Mexican-born driver to win a NASCAR national series race, serves as the unofficial ambassador for the Mexico City race.

Hailing from Monterrey, Suarez has competed at this venue 13 times in NASCAR’s Mexico Series, securing three victories. His familiarity with the track and cultural connection to the event make him a focal point, though he faces pressure both on and off the track.

Currently ranked 28th in the Cup Series standings and in a contract year with Trackhouse, Suarez aims to deliver a strong performance in front of an expected crowd that includes over 100 friends and family members.

The logistical undertaking to bring NASCAR to Mexico City has been monumental. Haulers departed Michigan International Speedway on June 8, traveling over 2,300 miles to reach the Autódromo. Xfinity Series teams crossed the border earlier, coordinating a complex operation to transport race cars, backup vehicles, and equipment.

NASCAR’s planning began over a year ago, with meticulous scheduling to ensure a seamless event. The organization’s commitment to this race reflects its broader strategy to grow the sport globally, exposing it to new audiences and potential sponsors while showcasing its top talent.

For fans, the weekend promises a festival of racing. The NASCAR Mexico Series will also compete, featuring events on June 13 and 14, with local drivers like Andres Perez De Lara and Ruben Rovelo making their Xfinity Series debuts alongside Suarez.

The Cup Series race, broadcast on Prime Video, and the Xfinity Series event on The CW, will reach a global audience, amplifying the event’s impact. Shane van Gisbergen, a road course specialist, enters as the betting favorite, while veterans like Denny Hamlin, who may miss the race due to the impending birth of his child, add intrigue to the storyline.

NASCAR’s return to Mexico City is more than a race; it’s a bold step toward international expansion. By embracing the challenges of a new market and celebrating the sport’s diversity, NASCAR aims to write a new chapter in its history, one that resonates with fans both in Mexico and beyond.

MEXICO CITY (AP) — Denny Hamlin will miss NASCAR’s first international race of the modern era to remain in North Carolina following the birth of his child.

Ryan Truex will replace him Sunday in Mexico City.

“See you guys in Pocono,” Hamlin posted on social media. “We are happy to announce the birth of our son. Everyone is doing well. My main priority is to be here at home for Jordan and our family over the next few days when she is able to go home and we transition to life as a family of five.”

Hamlin and fiancee Jordan Fish now have three children, two daughters and a son born Wednesday. Hamlin had been on baby watch the last 12 days as Fish went nearly two weeks past her predicted due date.

He had planned to get out of the car at Michigan last Sunday if she went into labor early in the race, but when the first stage passed with no word, he went on to score his third win of the season. The victory was the 57th of his career and made him the all-time winningest driver at Joe Gibbs Racing.

Through 15 races this season, Hamlin ranks third in the overall Cup Series standings.

Truex, younger brother of former JGR full-time driver Martin Truex Jr., is Gibbs’ reserve driver. His last Cup Series start was in 2014 and he has 26 starts at NASCAR’s top level.

Hamlin will need NASCAR to grant him a waiver to be eligible to compete in the playoffs for the Cup Series championship. NASCAR during the offseason tightened the rules for granting waivers, but said it would permit a driver skipping an event for the birth of a child.

The 44-year-old Hamlin will snap his streak of 406 consecutive starts. Hamlin last missed a race in 2014 at California Speedway because of an eye irritation.

Two-time reigning Pro Stock Motorcycle champ Herrera took the win last year over his rival Matt Smith. Herrera continues to lead the field, while others to look for at Norwalk will be Gadson, who won in Bristol, Angie Smith, Jianna Evaristo and Chase Van Sant.

For 2026, KTM will build 150 units of the limited edition KTM 450 RALLY REPLICA dirt bike. KTM will also produce five ultra-exclusive units of the KTM 450 RALLY REPLICA SANDERS EDITION. From Malle Moto privateers to Rally2 and RallyGP riders, the KTM 450 RALLY REPLICA has proven itself. KTM developed this bike using insights from Dakar champions like Marc Coma, Matthias Walkner, Toby Price, Kevin Benavides and Daniel Sanders. The result is a machine that represents the peak of Rally Raid engineering and competition.

KTM completely overhauled the model ahead of the latest Dakar Rally, which Sanders won in dominant fashion. Edgar Canet added an impressive Rally2 class victory for KTM at the same event. Emanuel Gyenes also secured victory in the “unsupported” Original by Motul class riding a KTM 450 RALLY REPLICA. He completed an all-KTM class podium that reinforced the bike’s competitive edge.

Built to Conquer Any Terrain

KTM powered the bike with a proven 450 cc SOHC fuel-injected engine and six-speed gearbox. The premium KTM hydraulic clutch enhances durability and control under tough conditions. Dual radiators provide consistent cooling in extreme environments and long-distance rally stages. KTM’s Motorsports facility hand-welded the laser-cut, hydro-formed frame sections for strength and feedback. The frame ensures energy absorption and straight-line stability for rally racers. A die-cast aluminum swingarm adds balance, stiffness and resilience over rugged terrain.

KTM designed three tanks — two front and one rear — with a combined 34.5-liter fuel capacity. This setup prepares riders for demanding rally stages without frequent refueling stops. The 2026 model includes WP PRO COMPONENTS suspension for maximum comfort and race-ready adjustability. KTM mounted the 48-millimeter WP XACT PRO 7548 fork using CNC-machined 23-millimeter offset triple clamps. The upper clamp integrates KTM’s PHDS system and a SCOTTS steering damper for steering control. At the rear, the WP XACT PRO 7750 fully adjustable shock adds stability and rider confidence.

KTM spent more than a decade refining the cockpit to maximize rider comfort and endurance. A specially designed fairing reduces wind turbulence and rider fatigue during long rally stages. A carbon fiber navigation tower integrates perfectly with KTM’s rally dashboard. The dashboard includes built-in warning lights and mounting points for a digital roadbook system.

KTM fitted a powerful LED headlight package for early starts and late-night rides to the bivouac. The bike includes essential safety tools built directly into the chassis. KTM engineered the bike for high output, low weight and nimble handling in varied terrain. Riders can confidently tackle everything from rocky ravines to open desert dunes.
